These Terms of Service ("Terms") are a legal agreement between you and TOM Pharmacy Consulting, LLC ("TOM," "we," "us"), a Texas limited liability company.
By creating an account, you agree to these Terms of Service and any policies referenced here.
TOM provides pharmacy compliance software for consultant pharmacists and ambulatory care facilities.
A Business Associate Agreement (BAA) is required for all subscribers. Protected Health Information (PHI) is processed in accordance with HIPAA. Subscribers must execute a BAA prior to entering any PHI into the platform.
TOM Compliance is $349/month per facility and auto-renews monthly. Annual billing is available at $299/month per facility ($3,588/year). All prices are subject to change with 30 days' notice.
New subscribers receive a 14-day free trial. A valid payment method is required to start the trial. You will not be charged until day 15. You may cancel at any time during the trial.
Users are responsible for maintaining the confidentiality of account credentials and PINs and for all activity under their accounts.
Anonymized operational data may be used for benchmarking and industry research. No facility-identifying information is shared without explicit written consent. Users may opt out of specific data uses in Settings.
Data is retained for 10 years after account cancellation to support regulatory and compliance obligations. Data export is available in JSON format at any time.
TOM targets 99.9% uptime for all production services. Scheduled maintenance windows will be communicated in advance.

TOM owns the software platform and related intellectual property. Users retain ownership of their facility data.
TOM is a documentation and workflow tool and is not a substitute for professional pharmacy judgment or legal/regulatory advice.
Either party may terminate service with 30 days' notice. Data export is available in JSON format prior to termination. Data is retained for 10 years after cancellation per our retention policy.
These terms are governed by the laws of the State of Texas.
